Former House Speaker Newt Gingrich (R-GA) is expected to warn of a “potential judicial coup d’état” during a congressional hearing on Tuesday focused on the growing influence of federal judges, according to prepared remarks obtained by The Daily Wire.

Gingrich will testify before a joint session of two House Judiciary Committee subcommittees, addressing concerns about the U.S. judicial system and potential solutions to what he views as overreach by federal courts.

In recent months, judges have issued broad injunctions that have blocked key parts of President Donald Trump’s agenda—from the dismissal of probationary federal employees to the deportation of suspected gang members, the outlet reported.

“There is clearly a potential constitutional crisis involving the Judicial Branch’s effort to fully override the Legislative and Executive branches,” a draft of Gingrich’s remarks says. “Fifteen District Judges effectively seized control of various Executive Branch duties in the first six weeks of the current presidency through nationwide injunctions.

“This is potentially a judicial coup d’etat. It clearly violates the Constitution and more than 200 years of American history,” he added.

Gingrich is scheduled to appear alongside Heritage Foundation legal scholar Paul Larkin and Tren de Aragua victim Cindy Romero at the hearing, which will be held jointly by the Subcommittee on the Constitution and Limited Government and the Subcommittee on Courts, Intellectual Property, Artificial Intelligence, and the Internet.

In his prepared remarks, Gingrich highlights that since President Trump returned to office on January 20, 2025, federal judges have already issued 15 nationwide injunctions against his administration—surpassing the totals issued during the entire presidencies of George W. Bush (6), Barack Obama (12), and Joe Biden (14).

According to Gingrich, 92% of the injunctions against Trump have come at the hands of judges appointed by Democratic presidents. “The notion that unelected lawyers can micromanage the Executive Branch – and override a Commander in Chief who received 77.3 million votes – should trouble every American,” Gingrich writes.

The former House Speaker will urge Supreme Court Chief Justice John Roberts to establish a rule that requires any nationwide injunction issued by a lower court to be reviewed by the Supreme Court immediately.

Gingrich also called on lawmakers to support the “No Rogue Rulings Act,” legislation that would limit judges to issuing injunctions only affecting the specific parties involved in a case. The bill, introduced by Rep. Darrell Issa (R-CA), is being championed by Issa and Rep. Chip Roy (R-TX), who serve as co-chairs of the Subcommittee on the Constitution and Limited Government.
