Fani Willis Ordered to Pay Over $54K for Violating Open Records Law In Trump Case

Fulton County District Attorney Fani Willis has been ordered to pay more than $54,000 after a judge found that she “intentionally” violated Georgia’s open records laws in a case tied to her prosecution of President Donald Trump.
Superior Court Judge Rachel Krause issued the formal ruling on Friday, directing Willis to pay $54,264 in attorneys’ fees and litigation costs. The violation stemmed from her failure to provide documents requested by Ashleigh Merchant, the attorney who sought to disqualify Willis from prosecuting Trump over alleged election interference in 2020.
The documents in question were related to the employment of Nathan Wade, the former special assistant district attorney who was forced to step down after it was revealed that he had a romantic relationship with Willis. Merchant argued that Willis and Wade may have personally benefited from his appointment as special prosecutor.
According to the court order, Atlanta Public Records Officer Cordell Bond admitted that while he usually called requesters for clarification on records requests, he refused to communicate with Merchant by phone. The order criticized this as showing “a lack of good faith.”
“Defendants’ failures were intentional, not done in good faith, and were substantially groundless and vexatious,” the ruling stated.
Merchant responded to the decision on X, writing, “Proud that we have judges willing to hold people in power accountable when they ignore the law!!!!”
Willis’ office has 30 days to pay the fine and must also provide the requested documents as directed by the court.
