Hoaxer Jussie Smollett Going Back to Jail After Conviction Upheld on Appeal

Disgraced actor Jussie Smollett’s conviction for staging a hate crime against himself has been upheld by an Illinois appeals court.

The three-panel court voted 2-1 to maintain the 2021 conviction, where Smollett was found guilty of five of six charges of disorderly conduct, including wasting police time. Smollett, who initially claimed to be the victim of a racist and homophobic attack by MAGA hat-wearing white men, spent six days in Cook County jail before being released pending appeal.

With the conviction upheld, he will now return to serve the remaining days of his 150-day sentence.

Justice David Navarro emphasized that the 2019 agreement with the Cook County State’s Attorney’s Office did not represent a final disposition, leaving room for further prosecution, the Messenger reports.

The prosecution argued that Smollett had hired the Osundairo brothers to stage the attack, presenting evidence like surveillance footage of a dry run before the incident. Smollett’s defense had previously sought dismissal, citing Fifth Amendment rights violations.

The case may still be appealed to the Illinois Supreme Court, prolonging the legal saga surrounding the actor’s actions.

Smollett’s claims were supported by many in high positions, including Vice President Kalama Harris, who wrote, “Jussie Smollett s one of the kindest, most gentle human beings I know. I’m praying for his quick recovery.

“This was an attempted modern day lynching. No one should have to fear for their life because of their sexuality or color of their skin. We must confront this hate.”
