GOP Lawmaker Seeks to Make Public IRS Whistleblower Testimony About Hunter Biden


House Ways and Means Committee Chairman Jason Smith said the panel would have hearings on Thursday to review claims made by several IRS whistleblowers regarding the tax agency’s investigation into first son Hunter Biden and that he would then seek to make the findings public.

“Ways and Means Committee members have received multiple whistleblower reports of misconduct at the IRS and other agencies regarding interference and government abuse in the handling of a matter involving a high-profile individual,” Smith, a Missouri Republican, said in a statement.

“If the federal government is not treating all taxpayers equally, Congress has a duty to hold agencies accountable by providing transparency and bringing new facts to light. That is why during Thursday’s session we will follow where the facts lead and will release the appropriate details afterward. The balance of justice must not be skewed in favor of the wealthy and the politically connected,” he added.

On Tuesday, the son of President Joe Biden entered into a plea deal with federal prosecutors in relation to his failure to pay approximately $1 million in taxes and his acquisition of a handgun. As a result of the agreement, Hunter Biden likely won’t spend a day in prison.

The deal ends a long-running Justice Department investigation into the taxes and foreign business dealings of President Biden’s second son, who has acknowledged struggling with addiction following the 2015 death of his brother, Beau Biden.

It also averts a trial that would have generated days or weeks of distracting headlines for a White House that has strenuously sought to keep its distance from the Justice Department.

The hearing comes after Gary Shapley, a 14-year IRS special agent, broke his silence about the Hunter Biden probe after seeking whistleblower protections earlier this year.

In late May, he spoke to CBS News and said federal prosecutors were giving special treatment to the president’s son.

“When I took control of this particular investigation, I immediately saw it was way outside the norm of what I’ve experienced in the past,” he said, adding that he was frustrated with the Delaware U.S. attorney’s office’s slow progress in the case.

“There were multiple steps that were slow-walked — were just completely not done — at the direction of the Department of Justice,” the whistleblower said.

“These deviations from the process,” he said, “seemed to always benefit the subject.”

“It just got to that point where that switch was turned on. And I just couldn’t silence my conscience anymore,” he said.

The existence of a whistleblower inside the Hunter Biden probe became known last month after one of Shapley’s attorneys, Mark Lytle, wrote to Congress seeking legal protections for his client, who was maintaining his anonymity at the time. Without those protections, Shapley said he can’t share anything about a taxpayer investigation—including the identity of the subject— without breaking tax secrecy laws.

CBS News obtained a letter Shapley’s attorneys sent last week to the Office of the Special Counsel, a federal agency dedicated to assisting government whistleblowers. The letter alleges “irregularities” in the Department of Justice’s handling of the case,and cites a “charged meeting” Shapley’s team had with Justice Department prosecutors last October.

According to the letter, following that meeting, Shapley’s team was effectively excluded from the investigation. Shapley would not say if he made prosecutors aware of his concerns but did acknowledge the incident prompted him to blow the whistle.

Earlier this week, CNN reported that “Hunter Biden will plead guilty to two federal tax misdemeanors and one charge tied to gun possession, according to the filing in a federal court in Delaware. He will appear in court to plead guilty to the charges at a future date.”
