A judge in El Paso, Texas made a huge and destructive decision on Monday, dismissing cases against 140 illegal immigrants linked to a border incident where they clashed with border patrol agents at the US-Mexico border earlier this month.
Despite this dismissal, the illegals are not completely off the hook. They still face federal charges related to their unlawful entry into the country, a process where many are granted court dates years down the line and released freely into various parts of the United States, usually with the assistance of free flights courtesy of the Biden administration.

The ruling came after County Court Judge Ruben Morales concluded that the Texas Department of Public Safety and state troopers hadn’t provided sufficient evidence to support probable cause for charging those involved in the April 12 incident.

El Paso County Public Defender Kelli Childress noted a key absence in the affidavit: no eyewitnesses directly implicated the defendants in the riot. On the other side, El Paso Assistant District Attorney Jennifer Vandenbosch contended that by awaiting someone to breach the concertina wire, the accused demonstrated clear intent.

After the hearing, Childress emphasized that this dismissal was just one step, indicating that the district attorney’s office could still pursue riot charges through a grand jury indictment.
These individuals will now transition from state to federal custody to address their illegal entry charges. However, two others facing similar charges did not have their cases dismissed. One was already in federal custody, while the other faced a distinct charge of criminal mischief rather than participation in the riot.
The legal proceedings underscore the ongoing complexities at the US-Mexico border and the challenges authorities face in prosecuting such cases.
